Terms of Use

These terms govern use of DW Hub (the “Application”), a private business application operated by Daniel Witzel Consulting (“we”) at hub.danielwitzel.com. By signing in you agree to them. If you do not agree, do not use the Application.

1. Who may use it

The Application is for our staff, contractors, and others we have explicitly authorized. It is not a public service and there is no self-service registration. Accounts are issued by an administrator and may be suspended or withdrawn at any time, with or without notice.

2. Your account

• Your credentials are personal to you. Do not share them or let anyone else use them.
• Keep your password confidential, and enable two-factor authentication where asked to.
• You are responsible for what happens under your account. Tell us immediately if you believe it has been compromised.
• Access tokens issued for automated integrations are credentials in the same sense and must be treated with the same care.

3. Acceptable use

You agree not to:

• Use the Application for anything other than our legitimate business purposes.
• Enter data you are not entitled to hold or share, including confidential information belonging to a third party.
• Attempt to access accounts, records, or systems you have not been granted access to, or to probe, scan, or interfere with the Application’s security.
• Extract data in bulk for any purpose other than a backup or export we have authorized.
• Interfere with anyone else’s use of the Application.

4. Data you enter

Records created in the Application — client details, projects, tasks, time entries, invoices, and the rest — are business records belonging to Daniel Witzel Consulting, not to the individual account that entered them. Handling of personal information is described in our Privacy Policy, which forms part of these terms.

5. Connected services

The Application connects to third-party services, including QuickBooks Online for invoicing. Authorizing such a connection is an action taken on behalf of the business and may only be done by an administrator. Actions taken through those integrations are real: an invoice created in QuickBooks is a real accounting record. Check what you are sending before you send it.

Your use of a connected service also remains subject to that provider’s own terms. We are not responsible for their availability, accuracy, or conduct.

6. Availability

The Application is provided on an as-available basis. We may change, suspend, or discontinue any part of it, and we perform maintenance that may make it temporarily unavailable. We do not guarantee any particular level of uptime.

7. No warranty

The Application is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that it will be uninterrupted, error-free, or that any data in it is complete or accurate. Figures produced by the Application, including invoice totals, should be reviewed by a person before they are relied upon.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or in connection with your use of the Application, whatever the theory of liability and even if we have been advised of the possibility.

9. Termination

We may terminate or suspend your access at any time, including on the ending of your employment or engagement. Sections 4, 7, 8, and 10 survive termination.

10. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, and the state and federal courts located in California have exclusive jurisdiction over any dispute arising from them.

11. Changes

We may update these terms. The date at the top will change, and continued use after that constitutes acceptance.
